KSA Successfully Blocks Maltese Operator Linked to Murder from Entering Dutch Gambling Market
The Kansspelautoriteit (KSA) made a significant announcement that the court in Hague has supported the regulator’s decision to block a Maltese operator with alleged ties to the murder of investigative journalist, Daphne Caruana Galizia. This decision came after the Dutch regulator rejected the gambling company’s application in 2023, leading to legal action being taken.
Background of the Operator’s Application
The Malta-based operator had submitted an application for a license in 2023 with the aim of participating in the growing gaming market in the Netherlands. However, the KSA raised concerns about the company’s alleged involvement in the murder of Daphne Caruana Galizia, a renowned journalist who investigated bribery and corruption scandals within the gambling industry.
Caruana Galizia tragically lost her life in a car bombing in 2017 without being able to reveal her findings.
During the KSA’s routine integrity checks, the regulator sought further information from the license applicant. In particular, the KSA inquired about the potential connection of a former shareholder of the Maltese company to the murder of Galizia.
Upon finding that the information provided by the company was inaccurate, evasive, or incomplete, the KSA made the decision to deny the company a license.
Hague Court Supports KSA’s Decision
Despite legal action taken by the operator to challenge the KSA’s denial of its license application, the court in Hague has upheld the regulator’s decision. The court emphasized that the company’s provision of incorrect or incomplete information raised doubts about its reliability, thus justifying the refusal of a license.
The KSA stressed the importance of integrity tests in its role as the gambling regulator in the Netherlands. The authority reiterated its commitment to maintaining the highest regulatory standards and ensuring that licensees and license applicants demonstrate honesty and transparency.
KSA’s Ongoing Efforts in Monitoring Dutch Market
Addressing transparency issues, the KSA recently imposed a penalty payment order on a gambling company that had provided misleading information. Additionally, the regulator has continued to penalize and warn companies that violate the Netherlands’ gambling regulations by engaging in illegal gaming activities or breaching licensing rules.
Earlier this year, the KSA took action against an illegal bingo games provider and issued a EUR 1.05 million fine to an unlicensed operator based in Costa Rica. The regulator has vowed to enhance its oversight and intensify efforts to protect the Dutch market from fraudulent activities.
Recent proposals by Dutch lawmakers include raising the age limit for high-risk gambling products from 18 to 21 and granting the KSA more authority to block offshore companies. While the KSA has not opposed the latter proposal, it has expressed reservations about the former measure.
