Underdog Fantasy, a prominent Daily Fantasy Sports (DFS) operator, recently agreed to a significant $17.5 million settlement with the New York State Gaming Commission (NYSGC). This decision comes after the operator faced allegations of unlawful operations and will result in the withdrawal of its drafts and pick’em games from the New York market. Cooperation with the Investigation
The settlement, disclosed last Friday, follows an in-depth investigation by the NYSGC, which revealed that Underdog Fantasy used its temporarily licensed subsidiary, Synkt, to offer DFS contests that were not authorized under New York law. While the company maintained its innocence and disputed the regulator’s interpretation of the relevant statutes, it opted to settle the matter swiftly by removing its offerings and paying the imposed fine.
NYSGC Commission chair, Brian O’Dwyer, emphasized the importance of playing DFS through permitted or registered operators to ensure compliance with comprehensive regulations that safeguard New Yorkers.
Efforts to Re-enter the New York Market
Despite the temporary withdrawal from New York, Underdog Fantasy has set the stage for its comeback by seeking a permanent fantasy sports license in the state. By cooperating with the NYSGC, the company hopes to demonstrate its commitment to operating within the legal framework and improve its prospects of receiving approval to resume activities in one of its most profitable markets.
Nicholas Green, Underdog Fantasy’s general counsel, reaffirmed the company’s dedication to offering its contests to New Yorkers and expressed optimism about working with the commission to achieve this goal promptly.
Expansion Strategy Amid Regulatory Challenges
Underdog Fantasy’s decision to exit New York temporarily due to regulatory uncertainties has not deterred its overall expansion plans. While facing stiff competition from established operators like DraftKings and FanDuel in the state, the company is pushing forward with the rollout of its Pick’em Champions product in New Jersey and Delaware by the end of March.
Furthermore, Underdog Fantasy has adapted its business model across different states to adhere to varying regulatory frameworks. In 16 states, the company offers a peer-to-peer version of its games under the Champions brand, which has been instrumental in driving its expansion across the US amidst the constantly evolving regulatory landscape.
